Terms and conditions of sale

These terms govern sales made on auboiacier.fr. They are accepted by the customer before any payment.

1. The seller

Auboiacier, an artisan metal and wood workshop based in Saumur, Maine-et-Loire, France. Full company details and registration numbers: see the legal notice.

2. Products

Pieces are made by hand, to order, in our workshop. Wood and steel are living materials: slight variations in tone, grain and finish are normal and are not defects.

3. Prices and VAT

Prices are shown in euros and are the total amount payable: no tax and no fee is added at payment. The applicable price is the one displayed at the time of the order. Delivery and, where chosen, installation are priced before the order, according to the customer's town (article 6). The workshop's VAT treatment is stated on the invoice.

4. Ordering and payment

Catalogue pieces are paid by card at the time of the order, in full: the whole price is charged when ordering, and the invoice is sent automatically. Payment is handled by our provider Stripe; no card data is stored by Auboiacier. For bespoke work quoted individually, the payment terms are set out on that quote.

5. Production times

Every piece is made to order: nothing is held in stock. The production time is shown on each piece's own page, on the “Lead time” line — from 3 to 12 weeks depending on the model, the finishes chosen and the season. For bespoke work, the time is stated on the quote. That time starts on payment and is confirmed to you in writing when you order. Should we exceed it, we tell you: you may then ask us to deliver within a further reasonable period and, if that period is missed, cancel the order and be refunded under article 9.

6. Delivery

Delivery in mainland France is made by carrier, at a price calculated from the town, weight and size, shown before ordering and counted once per order; pieces without a delivery option on their page are delivered at no extra charge. It takes place on a date agreed with the customer. On the product page, the customer may ask the workshop to deliver and fit the piece itself: this service is charged according to the distance from Saumur, at the price shown before ordering, and counted once per order. It is the customer's responsibility to check that the piece can be brought to the installation site (access, stairs, doorways).

7. Right of withdrawal

Under article L221-28 3° of the French Consumer Code, the fourteen-day right of withdrawal does not apply to goods made to the consumer's specifications or clearly personalised. As our pieces are made to order with dimensions, timbers and finishes chosen by the customer, they fall under this exception and cannot be returned or exchanged, unless we expressly agree. If a piece were sold to you without personalisation and without being built to your measurements, the fourteen-day right of withdrawal would apply as usual: an email would be enough, and the refund would be made under article 9.

8. Warranties

All our pieces are covered by the legal warranty of conformity (two years from delivery) and by the legal warranty against hidden defects (two years from the discovery of the defect). In plain terms: if the piece does not match what was agreed, or if a hidden defect appears, repair, replacement, a price reduction or a refund is at our expense. The full wording of those rights is reproduced word for word in the official box at the end of these terms. Normal wear, and damage caused by misuse, unsuitable maintenance or modification of the piece, are excluded.

9. Claims, returns and refunds

Any claim should be sent to us by email, with photographs where possible, as soon as the piece arrives. We reply within 48 working hours and agree the next step with you: repair, replacement, price reduction or refund. Any refund due is paid no later than fourteen days after the right to it arises (withdrawal accepted, order cancelled, sale rescinded). It is made to the payment method used for the order — usually back to your card through Stripe — at no cost to you.

10. Personal data

We only collect what is needed to handle your order: name, email, phone, city and delivery address, order details and amount. Payment is processed by Stripe Payments Europe, emails are delivered by Resend, the site is hosted by Vercel; these providers act on our behalf. Order and invoice data are kept for ten years (accounting obligation). You may access, correct or erase your data, or object to its use, by writing to auboiacier@gmail.com; we answer within a month; you may complain to the CNIL (www.cnil.fr). 11. Consumer mediation

Write to us first: most disagreements are settled in a few emails. If our answer does not satisfy you, you may call free of charge on a consumer mediator. The contact details of the mediator our workshop is registered with are given with our written reply and appear on our invoices. You may also file your dispute on the European online dispute resolution platform: ec.europa.eu/consumers/odr.

12. Governing law

These terms are governed by French law. They are accepted by ticking the box in the cart, before payment. In the event of a dispute, an amicable solution is sought first (article 11); failing that, the French courts have jurisdiction.

Legal warranty of conformity and hidden defects — official wording

The text below is the wording required by French law. It is reproduced as it stands, unchanged.

The consumer has two years from delivery of the goods to obtain the benefit of the legal warranty of conformity should a lack of conformity appear. During that period, the consumer need only establish that the lack of conformity exists, not the date on which it appeared. The legal warranty of conformity entitles the consumer to repair or replacement of the goods within thirty days of the request, free of charge and without major inconvenience. If the goods are repaired under the legal warranty of conformity, the consumer benefits from a six-month extension of the original warranty. If the consumer asks for the goods to be repaired but the seller insists on replacement, the legal warranty of conformity is renewed for two years from the date of replacement. The consumer may obtain a reduction in the purchase price and keep the goods, or end the contract and be refunded in full against return of the goods, if: 1. The trader refuses to repair or replace the goods; 2. The repair or replacement takes place after a period of thirty days; 3. The repair or replacement causes major inconvenience to the consumer, in particular where the consumer definitively bears the cost of taking back or removing the non-conforming goods, or bears the cost of installing the repaired or replacement goods; 4. The lack of conformity persists despite the seller's unsuccessful attempt to bring the goods into conformity. The consumer is also entitled to a reduction in the price of the goods or to rescission of the contract where the lack of conformity is so serious that an immediate price reduction or rescission is justified. The consumer is then not required to ask for repair or replacement first. The consumer is not entitled to rescission of the sale where the lack of conformity is minor. Any period during which the goods are unavailable for repair or replacement suspends the remaining warranty period until the repaired goods are delivered. The rights set out above arise from articles L. 217-1 to L. 217-32 of the French Consumer Code. A seller who obstructs in bad faith the operation of the legal warranty of conformity incurs a civil fine of up to 300,000 euros, which may be raised to 10% of average annual turnover (article L. 241-5 of the French Consumer Code). The consumer also benefits from the legal warranty against hidden defects under articles 1641 to 1649 of the French Civil Code, for two years from the discovery of the defect. That warranty gives a right to a price reduction if the goods are kept, or to a full refund against return of the goods.
